INTRODUCTION
Hello and welcome to Ease Into Technology, operated by Brovens Consulting Pty Ltd (ABN 20 169 300 396) ("we", "us", "our"). We are so happy to have you here.
These Online Store Terms and Conditions ("Terms") apply to all customers who purchase Products from us through our website (www.easeintotechnology.com) or via our Etsy store. By placing an order or completing a purchase, you agree to these Terms together with any other policies we publish or link to on our Website or Etsy store (together, the "Agreement").
In these Terms, "you" means any customer or user of our Website or Etsy store. If you do not agree to these Terms, you must not purchase any Products from us.
Please note that our Etsy store is subject to Etsy's own Terms of Use and seller policies, which apply in addition to these Terms. In the event of any inconsistency, Etsy's platform policies will prevail to the extent required by Etsy.
1. DEFINITIONS
In this Agreement, unless the context otherwise requires:
Agreement means these Terms and all other terms, conditions and policies published or linked to on our Website or Etsy store.
AI Tools means third-party artificial intelligence tools and platforms, including Microsoft Copilot, and any AI features within the Microsoft 365 (M365) suite.
Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Business Day means a day that is not a Saturday, Sunday or public holiday in Queensland, Australia.
Claim means any claim, demand, action, proceeding or award, whether under statute, tort, contract, negligence or otherwise, including legal costs.
Content means any photos, videos, testimonials, case studies or other information you provide to us.
Intellectual Property Rights means all copyright, trademarks, design rights, patents, trade secrets and confidential information, whether registered or unregistered.
Loss or Damage means any direct, indirect, incidental, punitive, special or consequential loss or damage of any kind, including but not limited to loss of profits, revenue, savings or data, loss of enjoyment, damage to systems, personal injury, property damage and legal costs.
Products means the digital guides and templates available for purchase through our Website or Etsy store, relating to workplace productivity and the use of AI Tools and M365 tools.
Third Party Platforms means Etsy and any other third-party marketplace or platform through which our Products are made available.
We, us or our means Brovens Consulting Pty Ltd (ABN 20 169 300 396), trading as Ease Into Technology, and includes our directors, officers, employees, agents and contractors.
Website means www.easeintotechnology.com and all content and services available on that website.
2. GENERAL DISCLAIMER — NOT PROFESSIONAL ADVICE
2.1 Our Products are general educational and informational resources only. They are designed to help individuals and businesses explore and apply AI Tools and M365 software in workplace settings.
2.2 Nothing in our Products constitutes professional advice of any kind, including but not limited to:
a) information technology (IT) or technical consulting advice;
b) legal, compliance or regulatory advice;
c) financial, accounting or tax advice;
d) human resources or employment advice; or
e) business strategy or management consulting.
2.3 You should not rely on our Products as a substitute for professional advice tailored to your specific circumstances. We strongly recommend that you seek independent professional guidance where your situation requires it.

3. AI TOOLS DISCLAIMER
3.1 Our Products provide guidance on the use of AI Tools, including Microsoft Copilot and features within the M365 suite. You acknowledge and agree that:
a) AI Tools are developed, maintained and updated by third-party providers (including Microsoft Corporation), and we have no control over their functionality, availability, accuracy or output;
b) AI Tools change frequently. Features, interfaces, prompts and capabilities described in our Products may be updated, altered, deprecated or replaced by the third-party provider at any time without notice to us or to you;
c) the information in our Products reflects our understanding of AI Tools as at the date of publication and may not reflect the current state of those tools;
d) AI-generated outputs are not guaranteed to be accurate, reliable, complete or appropriate for any particular purpose, and must be reviewed and verified by you before use or reliance;
e) your use of AI Tools is subject to the terms of service, privacy policies and acceptable use policies of the relevant third-party provider; and
f) we are not affiliated with, endorsed by, or in any way officially connected to Microsoft Corporation or any other AI Tool provider.
3.2 We are not responsible for any Loss or Damage arising from your use of, or reliance on, any AI Tool, including any output generated by an AI Tool in connection with our Products.
3.3 You are responsible for ensuring that your use of AI Tools in your workplace complies with all applicable laws and regulations, your organisation's internal policies, and any relevant data security or privacy obligations. Our Products do not constitute guidance on those matters.
3.4 Any references to Microsoft, Copilot, Microsoft 365, M365 or related brand names in our Products are for descriptive and educational purposes only. These are trademarks of Microsoft Corporation. We claim no proprietary interest in those marks.
4. BEFORE YOU PURCHASE
4.1 Eligibility
Before purchasing any Product, you confirm that:
a) you are at least 18 years of age, or you have obtained the consent of a parent or legal guardian;
b) all information you provide to us is accurate, complete and current, and you will promptly notify us of any changes;
c) you have adequate technology, software and internet access to receive, download and use digital products; and
d) any discount codes, special offers or coupons must be applied at the time of purchase and cannot be applied retrospectively.
4.2 About our Products
Our Products are digital guides and templates designed to help individuals and businesses improve workplace activities using AI Tools and M365 software. All Products are digital, no physical goods are supplied.
Our Products are available for purchase through:
a) our Website at www.easeintotechnology.com; and
b) our Etsy store.
4.3 Acknowledgements on purchase
You acknowledge that:
a) there may be occasional errors or omissions in Product descriptions, pricing, availability or promotions;
b) technical difficulties may occasionally affect access to or delivery of Products; and
c) some Products may be available in limited quantities or restricted to certain regions.
Except as required by law, we cannot guarantee the accuracy of all information on our Website or Etsy store, or the uninterrupted availability of Products.
Once an order is placed and payment is processed, we may not be able to cancel it. Please review your selection carefully before completing your purchase.
5. AFTER PURCHASE
5.1 Digital delivery
After completing your purchase, you will receive access to or a download link for your Product. It is your responsibility to download and save your digital files promptly.
5.2 Your obligations
After purchasing a Product, you must:
a) follow any instructions we provide in relation to the Product;
b) contact us at [email protected] within 48 hours if you experience any issues downloading or accessing a Product, or if you wish to request a refund;
c) not reproduce, duplicate, copy, sell, resell, share or exploit the Products in any way without our prior written consent; and
d) obtain our prior written consent before publishing any information about us.
If a dispute arises between us, please keep all communications confidential.
5.3 We love hearing from you
We love hearing from our customers. If you have photos, videos, testimonials or case studies you would like to share, we would be delighted to hear from you. We may use such Content for marketing, publications, exhibitions and professional awards across print and digital channels, including our social media.
By providing Content to us, you assign to us all copyright and other rights in that Content under the Copyright Act 1968 (Cth), including the right to reproduce it in whole or in part. If you later wish to revoke permission, please notify us immediately at [email protected].
6. INTELLECTUAL PROPERTY
6.1 All Intellectual Property Rights in the Products are owned by or licensed to us. Nothing in this Agreement transfers any Intellectual Property Rights to you.
6.2 We grant you a non-exclusive, non-transferable, royalty-free, revocable licence to use the Products for your own business or personal use only. This licence does not permit you to:
a) share, distribute or supply the Products to any third party;
b) reproduce, copy or resell the Products in any form;
c) modify, adapt or create derivative works from the Products without our prior written consent; or
d) use the Products in a manner that infringes our Intellectual Property Rights or any third party's rights.

7. PRICING AND PAYMENT
7.1 All prices displayed on our Website and Etsy store are in Australian dollars (AUD) and are exclusive of any applicable goods and services tax (GST) unless otherwise stated.
7.2 Prices are subject to change at any time without notice. The price applicable to your order is the price displayed at the time you complete your purchase.
7.3 Payment must be made in full at the time of purchase using a payment method accepted on our Website or Etsy store. You must not attempt to pay by fraudulent, unauthorised or declined means.
7.4 Where you purchase through our Etsy store, payment processing is governed by Etsy's payment terms. We are not responsible for any fees, charges or currency conversions applied by Etsy or your payment provider.
8. REFUNDS AND CONSUMER GUARANTEES
8.1 Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any reasonably foreseeable loss or damage. You are also entitled to have Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
8.2 Nothing in this Agreement excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.
8.3 Except as required by law, we do not provide refunds where:
a) you have changed your mind after purchase;
b) a problem with the Product arises from your own misuse or failure to follow our instructions;
c) you have failed to provide us with adequate information; or
d) you have successfully downloaded and accessed the Product.
8.4 To request a refund or report an issue, please contact us at [email protected] within 48 hours of purchase. Where your purchase was made through Etsy, you may also be entitled to raise a case through Etsy's case system.
9. CHANGES, CANCELLATIONS AND REFUSALS
9.1 Except as required by law, we may change Product information, pricing, promotions and availability on our Website or Etsy store at any time without notice.
9.2 We reserve the right to refuse, limit or cancel any order, including where an order appears to be placed by resellers or distributors without our authorisation.
9.3 If we cancel your order, we will provide you with a full refund of the amount paid.
9.4 We may stop providing our Website or Products at any time. We may also restrict or suspend your access to our Website or Etsy store if you breach this Agreement.
10. ETSY PLATFORM
10.1 Where you purchase a Product through our Etsy store, your purchase is also subject to Etsy's Terms of Use and applicable platform policies, including Etsy's seller policies and buyer protections. You should familiarise yourself with those terms at www.etsy.com/legal.
10.2 We comply with Etsy's seller policies and standards, including Etsy's Intellectual Property Policy and Creativity Standards. All Products listed on our Etsy store are original works created by us.
10.3 Etsy is an independent platform. We are not affiliated with, endorsed by, or acting as an agent of Etsy Inc. Etsy has no liability for our Products, and we have no liability for Etsy's platform, services or conduct.
10.4 If you are located in the European Union or United Kingdom, you may have additional rights under Etsy's platform policies, including rights relating to digital content. Please refer to Etsy's policies for details.
11. LIABILITY AND INDEMNITY
11.1 To the maximum extent permitted by law, we are not liable for any Loss or Damage arising from:
a) your use of our Website, Etsy store or Products;
b) any errors, omissions, price changes or discontinued Products;
c) your reliance on the information in our Products, including guidance relating to AI Tools;
d) the performance, accuracy or availability of any AI Tool or Third Party Platform;
e) any links to third-party websites;
f) any interruption, suspension or termination of our Website or Products; or
g) any misuse of a Product by you or any third party.
11.2 To the extent we are entitled to limit our liability under the Australian Consumer Law, our liability will be limited, at our option, to:
a) the replacement of the Products or supply of equivalent products; or
b) the payment of the cost of replacing the Products or acquiring equivalent products.
11.3 In any event, our total liability to you will not exceed the amount you actually paid us for the most recent Product purchased.
11.4 You agree to indemnify us and keep us indemnified against any Claim arising out of or in connection with your breach of this Agreement, including any breach of our Intellectual Property Rights, and against all Loss or Damage we suffer as a result.
12. PRIVACY
12.1 We collect and handle personal information in accordance with our Privacy Policy (available on our Website) and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
12.2 By using our Website or purchasing any Product, you consent to the collection and use of your personal information as described in our Privacy Policy.
12.3 Where you purchase through our Etsy store, Etsy may also collect and handle your personal information in accordance with Etsy's Privacy Policy.

13. FORCE MAJEURE
We will not be in breach of this Agreement to the extent that our obligations cannot be performed due to a Force Majeure Event, meaning any event outside our reasonable control including natural disasters, acts of government, internet or telecommunications outages, third-party platform outages (including Etsy), and pandemics. We will not be liable to you for any Loss or Damage arising from such an event.
14. DISPUTE RESOLUTION
14.1 If a dispute arises in connection with this Agreement, the parties must first attempt to resolve it by good faith negotiation.
14.2 If the dispute cannot be resolved by negotiation within 10 Business Days of written notice, either party may refer the dispute to an independent arbitrator or dispute resolution specialist. Each party will bear its own costs of that process.
14.3 Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief from a court.
14.4 Where your purchase was made through Etsy and you are unable to resolve a dispute directly with us, you may also raise a case through Etsy's case system in accordance with Etsy's platform policies.
15. GENERAL
15.1 Governing law. This Agreement is governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.
15.2 Entire agreement. This Agreement is the entire agreement between you and us in relation to its subject matter and supersedes all prior agreements, proposals and communications, whether oral or written.
15.3 Waiver. Our failure to exercise or enforce any right or provision of this Agreement does not waive that right or provision.
15.4 Severability. If any provision of this Agreement is found to be unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue in full force and effect.
15.5 Amendments. We may update or amend these Terms from time to time. Updated Terms will be posted on our Website and will apply to all purchases made after the date of posting. Continued use of our Website or Etsy store after updated Terms are posted constitutes your acceptance of those updated Terms.
15.6 Survival. All obligations and liabilities that by their nature are intended to survive termination of this Agreement will continue after termination.
